Probate and Deceased Estates
Description
Probate is a formal action to establish the validity of the dead person's wish. A Probate Estates consists of the property of a deceased person who requires the appointment of a fiduciary.Probate Estates are only titled on the name of the deceased. Probate assets can include any types of assets, including: real estate, bank accounts, brokerage and investment accounts, promissory notes, contracts for deed, stock etc. In addition, real estate is included in the rental of tenants in the Probate Estates. However, the properties held in the joint tenancy with the right to survive are excluded from Probate Estates.
